We're excited to have you here. These Terms explain how the Program works and what each of us can expect from the relationship. They're designed to protect both you and H2Glow while giving us the flexibility to continue improving the Program over time.
These Affiliate Program Terms ("Terms") govern your participation in the H2Glow Affiliate Program (the "Program"), operated by Bellaful Inc. d/b/a H2Glow ("H2Glow," "we," "our," or "us"). By applying to, joining, or participating in the Program through Tapfiliate or another approved platform, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, provide accurate account, payment, and tax information, and maintain your account in good standing. Participation is by invitation or application. We may review participation periodically to ensure the Program continues to reflect H2Glow's standards and values.
2. Independent Relationship
You participate as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, franchise, or joint venture relationship. You are responsible for your own taxes and business expenses and may not represent yourself as an employee or agent of H2Glow.
3. Affiliate Links and Qualifying Sales
Each Affiliate receives a unique tracking link. A Qualifying Sale is a completed purchase properly attributed through your assigned link, within the attribution window published in the Program, that is not cancelled, refunded, charged back, fraudulent, or otherwise excluded. Self-referrals, purchases by members of your household, or purchases made through accounts you control are not Qualifying Sales.
4. Commissions
Current commission rates, payout thresholds, and payment timing are communicated within the Program dashboard. Commissions are earned only on Qualifying Sales and become payable after the applicable return and fraud review periods. H2Glow may offset refunds, returns, chargebacks, duplicate payments, or other overpayments against future commissions.
5. Optional Program Benefits
H2Glow may offer optional incentives including paid amplification, contests, bonuses, customer discounts, tier recognition, product seeding, or other promotional opportunities. These benefits are discretionary, may change or end at any time, and do not create a contractual entitlement unless expressly stated.
Some benefits, including paid amplification, require you to complete the setup and permissions described in the Program Materials, such as granting and maintaining partnership permissions on your social platforms. H2Glow may decline, pause, or withhold any benefit until those requirements are met.
6. Marketing Standards
You are responsible for complying with all applicable advertising laws, FTC endorsement requirements, platform policies, and H2Glow Creator Guidelines. Every promotional post must clearly disclose your relationship with H2Glow using an appropriate disclosure such as #H2GlowPartner or #ad. Your organic posts stay organic; the platform Paid Partnership label is applied only when H2Glow boosts a post. You may only make truthful, substantiated statements and may not make medical, disease-treatment, drug, or otherwise misleading claims.
7. Content and Intellectual Property
You retain ownership of your original content. You grant H2Glow a perpetual (unless you request removal in accordance with these Terms), worldwide, royalty-free, non-exclusive license to repost, display, and distribute content featuring H2Glow across H2Glow-owned and organic channels, including the H2Glow website, owned social accounts, email, and other non-paid marketing.
You may request that H2Glow stop using a specific piece of content on a going-forward basis at any time, and H2Glow will honor that request within a reasonable period, except for content already incorporated into a live campaign or previously produced materials, which may continue to run.
If H2Glow uses your content in paid advertising, the paid media license lasts six (6) months from first use unless otherwise agreed in writing.
H2Glow may crop, resize, caption, subtitle, translate, localize, or otherwise edit content, including AI-assisted editing tools used for formatting, accessibility, localization, translation, subtitles, resizing, or similar production purposes, provided such edits do not materially alter your opinion or endorsement.
You represent that you own or have secured all rights in your content and everything it contains, including music, footage, and the rights of any individuals who appear, that it does not infringe any third-party rights, and that you have obtained any releases needed for H2Glow's use, including for any music or third-party materials in content used in paid advertising.
8. Brand Assets
H2Glow grants you a limited, revocable license to use approved logos, trademarks, and marketing materials solely for participation in the Program. All intellectual property remains the exclusive property of H2Glow.
9. Prohibited Conduct
You may not engage in spam, fake reviews, cookie stuffing, click fraud, unauthorized coupon distribution, trademark bidding, misleading advertising, unlawful conduct, automated traffic generation, or any activity intended to manipulate attribution or harm consumers or the H2Glow brand.
10. Program Changes
H2Glow may modify commission rates, eligibility requirements, promotional opportunities, or Program policies by updating the Program Materials. Changes apply prospectively unless otherwise stated and do not affect commissions already earned on Qualifying Sales. We will make reasonable efforts to notify participants of material changes before they become effective.
11. Suspension and Termination
Either party may end participation at any time. H2Glow may suspend or terminate participation where reasonably necessary to protect the integrity of the Program, investigate fraud, comply with law, or protect the H2Glow brand. Approved commissions earned before termination remain payable subject to these Terms. If we remove you from the Program, you remain entitled to approved commissions earned before removal, but your eligibility for paid amplification and other optional benefits ends immediately.
12. Confidentiality
Any non-public information shared through the Program, including future launches, pricing, promotional plans, or internal business information, must be kept confidential unless H2Glow authorizes disclosure or disclosure is required by law.
Confidential Information includes product formulations, research, clinical information, pricing, financial information, marketing strategies, customer information, business plans, future product launches, and other non-public information shared through the Program. Participants must keep this information confidential unless disclosure is authorized by H2Glow or required by law.
13. Disclaimer and Limitation of Liability
The Program is provided "as is." H2Glow does not guarantee earnings, traffic, sales volume, or promotional opportunities. To the fullest extent permitted by law, H2Glow's liability arising from the Program is limited to commissions properly owed under these Terms. H2Glow will not be liable for indirect, incidental, special, or consequential damages.
14. Indemnification
You will defend and indemnify H2Glow from any third-party claims, damages, and expenses arising from your content, your marketing, your breach of these Terms, or your violation of any law or third-party right.
15. Attorneys' Fees
Where indemnification applies, it includes reasonable attorneys' fees and related costs.
16. Administrative Corrections
H2Glow may correct administrative, technical, tracking, accounting, or calculation errors, including adjustments to commissions or benefits resulting from those errors.
17. Force Majeure
H2Glow is not responsible for delays or failures caused by events beyond its reasonable control.
18. Program Materials
'Program Materials' means the creator guidelines, FAQs, commission schedules, platform instructions, policies, promotional opportunities, and other materials H2Glow makes available for the Program.
19. Governing Law
These Terms are governed by the laws of the State designated by H2Glow in the Program Materials, without regard to conflict-of-law principles. Any disputes will be resolved in the applicable courts unless otherwise required by law.
20. General
These Terms, together with the Program Materials, constitute the entire agreement governing your participation in the Program. If any provision is held unenforceable, the remaining provisions remain in effect. Continued participation after updated Terms become effective constitutes acceptance of those updates. Headings are provided for convenience only and do not affect interpretation.
